Enforcement action against MYOM Australia Pty Ltd

The commission has taken enforcement action against MYOM Australia Pty Ltd (MYOM) for an alleged contravention of a condition of its accreditation under the Victorian Energy Upgrades (VEU) program.
Alleged breach
In October 2023, following a commission investigation that identified poor quality heat pump water installations, the commission imposed a condition on MYOM’s accreditation requiring them to meet rectification and reporting obligations within 20 business days.
MYOM allegedly failed to comply with that condition by not re-inspecting and rectifying four of the non-compliant heat pump water heater installations and not meeting reporting obligations within 20 business days. MYOM also allegedly created 52 Victorian energy efficiency certificates (VEECs) for a further non-compliant heat pump water heater installation.
The identified poor quality heat pump water heater installations have now been rectified by installers on MYOM’s behalf, at no cost to the consumers.
Our decision
The commission decided to:
- Refuse registration of 52 VEECs created for a further non-compliant heat pump water heater installation. This is in addition to the 481 certificates previously refused or surrendered for the non-compliant installations identified in October 2023, bringing the total value of certificates refused or surrendered to over $50,000.
- Formally reprimand MYOM for repeatedly but unintentionally creating VEECs that do not comply with the VEU program rules.
The commission acknowledged that since the alleged non-compliance, MYOM has implemented protocols to prevent similar issues from arising in the future and to ensure greater oversight of works completed by installers acting on its behalf.
