Enforcement action against Direct Building Solutions Australia Pty Ltd
A commission investigation identified conduct by an installer acting on behalf of accredited business Direct Building Solutions Australia Pty Ltd (Direct Building Solutions Australia) that resulted in alleged breaches of the Victorian Energy Upgrades (VEU) program rules.
Alleged breach
Direct Building Solutions Australia allegedly breached the VEU program rules, including the code of conduct, in relation to the following:
- Conduct by an installer acting on behalf of Direct Building Solutions Australia, including the use of high-pressure sales tactics, poor quality installations, and providing false information about the products being upgraded.
- The creation of 111 certificates for 57 weather sealing and shower rose installations that did not comply with the Victorian Energy Efficiency Target Act 2007.
Direct Building Solutions Australia, as the accredited business, is responsible for making sure any installer acting on its behalf, complies with the code of conduct, and that Victorian energy efficiency certificates are compliant with the law.
Direct Building Solutions Australia has cooperated with the commission’s investigation, conducted its own audit and taken steps to improve its training, quality assurance and compliance monitoring.
Our decision
The commission decided to:
- Refuse the registration of 81 certificates and require the surrender of 19 certificates associated with the alleged misconduct, together valued at almost $10,000 . Direct Building Solutions Australia voluntarily withdrew the remaining 11 certificates associated with the alleged misconduct.
- Warn Direct Building Solutions Australia against future non-compliance and reprimand it for contravening the program rules and code. Direct Building Solutions Australia has been reminded of its obligation to maintain adequate systems, policies and procedures to ensure compliance with the code of conduct by persons undertaking activities on its behalf.
