Cyanergy compliance breach 2020
In June 2020, we issued a warning and required Cyanergy to undergo an independent audit in response to the company’s alleged misconduct.
Cyanergy had allegedly submitted falsified installation invoices. Following an investigation by the commission, it was found that around 10 per cent of claimed Victorian energy efficiency certificates were therefore invalid.
Cyanergy surrendered 20,894 certificates.
Breaches included:
- alleged misconduct by an installer
- doctored invoices by an off-shore auditing company showing an overstatement of the number of lamps and baseline lamps, and incorrect baseline lamp technology used for certificate creation.
Following our five-month investigation, we found that Cyanergy had unknowingly submitted certificates which did not meet compliance requirements.
Cyanergy now must:
- sever ties with the installer
- overhaul their monitoring and auditing process
- engage an independent auditor to reviews processes and procedures to ensure this does not happen again.
The commission will also be referring the matter to Victoria Police.
