We accepted an enforceable undertaking from Momentum Energy about disconnection notices that did not comply with the Energy Retail Code.
Momentum Energy's enforceable undertaking for a disconnection compliance issue
The disconnection warning notices that Momentum Energy issued in 2018 did not comply with clause 110(2)(h) of the Energy Retail Code because they did not let smart meter customers know that they could be disconnected without someone having to visit the property.
Compensation payments to be made
Because the disconnection notices issued by Momentum Energy did not provide information to smart meter customers that they could be disconnected without someone having to visit the property, Momentum Energy is required to make a compensation payment to customers that received these disconnection notices and were later disconnected. This is a statutory licence condition under Section 40B of the Electricity Act.
Momentum Energy will contact all customers who are entitled to a compensation payment. They must attempt to contact customers through a variety of ways and over multiple periods.
Progress reports
Momentum Energy will report to us monthly on its progress in compensating customers.
